The service

Schedule's Up lets a business collect staff availability via no-login links and produce and share work schedules. You are responsible for the accuracy of the data you enter and for having permission to contact the people you add.

Messaging terms

Schedule's Up sends transactional, operational text messages on behalf of your business — for example, a link asking an employee to submit availability, or a link to a posted schedule. There are no marketing messages.

• Message frequency varies with how your business uses the service.
• Message and data rates may apply.
• Reply STOP to opt out at any time, or HELP for help.
• Carriers are not liable for delayed or undelivered messages. Delivery depends on your mobile carrier and is not guaranteed.

Providing a mobile number alone does not create SMS consent. A staff member consents only after the employer presents the SMS disclosure and the staff member actively agrees to receive scheduling text messages. SMS consent is optional; if a staff member does not consent or opts out, the employer can provide scheduling links another way.

Accounts & acceptable use

Keep your login credentials secure. Don’t use Schedule's Up to send unlawful, harassing, or unsolicited marketing content, and don’t add contact details you aren’t authorized to use. We may suspend accounts that violate these Terms.

Employer responsibilities & legal compliance

Schedule's Up is a scheduling tool. You — the employer or business using it — are solely responsible for ensuring that the schedules you create and the way you use the service comply with all applicable laws, including federal, state, and local wage-and-hour laws, the Fair Labor Standards Act, predictive-scheduling or “fair workweek” ordinances, rest break and overtime rules, restrictions on the employment of minors, and any collective-bargaining agreements. Schedule's Up does not provide legal, HR, payroll, or tax advice, and its draft schedules, coverage views, and conflict explanations are aids only — not a determination of legal compliance.

You are responsible for obtaining any consent required to contact the people you add (including parental or guardian consent where a worker is a minor) and for the accuracy of the data you enter.

Subscriptions & billing

Paid plans are billed in advance on a recurring basis and can be cancelled at any time; access continues through the end of the paid period. Fees are stated exclusive of taxes; applicable sales tax may be added at checkout.

Disclaimers & limitation of liability

Schedule's Up is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that messages will be delivered.

To the maximum extent permitted by law, Forged Cortex LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, data, or goodwill, or for any scheduling, staffing, or employment decisions you make using the service. Forged Cortex LLC’s total liability for any claim arising out of or relating to the service is limited to the amount you paid Forged Cortex LLC for the service in the twelve (12) months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Forged Cortex LLC harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of Schedule's Up, the data or messages you send through it, your relationship with the people you schedule, or your violation of these Terms or of any applicable law.
